The petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 20.05.2020 and has antecedent of six cases.
This is the third attempt of the petitioner to seek bail, it is next submitted that earlier, by order dated 25.04.2022 in Cr. Misc. No. 21331 of 2021, his bail application was rejected and thereafter, by order dated 02.11.2022 in Cr. Misc. No. 57935 of 2022, his bail application was again rejected. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.6041 of 2023(3) dt.15-03-2023 2/2 bail of the petitioner.
Considering the period of custody and in the nature of allegation as recorded in the order dated 25.04.2022 in Cr. Misc. No. 21331 of 2021, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kotwali P.S. Case No. 771 of 2019.
However, if the learned court below comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the court below shall forthwith cancel his bail bonds after recording reasons.
