The petitioner seeks bail in connection with Kabaiya P.S. Case No. 307 of 2025 instituted for the offence under Sections 329(4), 126(2), 115(2), 74, 303(2), 308(3), 324(4), 352, 351(2) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case, the petitioner along with other co-accused persons cut the lock of the shop and entered the house of the informant and they also abused the informant's family members. It is further alleged that they committed loot of gold of Rs. 10 lakh and 1.5 lakh in cash and fled away demanding Rs. 20 lakh as ransom.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.08.2025. Petitioner bears no criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR and his name has surfaced in this case during investigation. It is submitted that there is case and counter case between the parties bearing Kabaiya PS Case No. 308 of 2025. There is no specific allegation against the petitioner, rather the same is general and omnibus in nature. Other co-accused has been granted bail by this Court vide order dated 01.11.2025, passed in Cr. Misc. No. 71795 of 2025.

Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties
