JUSTICE RAJESH KUMAR VERMA ORAL ORDER 8 30-03-2026 Heard Ms. Bela Singh, learned counsel for the petitioners, Mr. Abhishek Kumar, learned counsel appearing on behalf of the informant as well as Mr. Sunil Kumar Pandey, learned Additional Public Prosecutor for the State.
2. Petitioners seeks bail in connection with Hajipur Sadar (Kazipur) P.S. Case No. 244 of 2025, F.I.R. dated 25.03.2025 for the offences punishable under Sections 316(2), 318(4), 338, 336(2), 308(5), 352, 351(2)(3), 126(2) of the Bharatiya Nyay Sanhita, 2023.
3. According to prosecution case, the informant alleged that the petitioners took money from him in the name of registry of land but did not do the same. It is further alleged that the
Patna High Court CR. MISC. No.75580 of 2025(8) dt.30-03-2026 2/3 petitioners threatened the informant and went to his site and abused the laborers and threatened them also.
4. Learned counsel for the petitioners submits that petitioners are innocent and they falsely been implicated in the present case merely on the basis of suspicion. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R and except suspicion, no other cogent material has come during investigation which suggest the involvement of the petitioner in the present occurrence. The police after investigation submitted charge-sheet and the petitioner no.1 is in custody since 21.08.2025 and petitioner no.2 is in custody since 13.08.2025.

The learned counsel appearing on behalf of the informant as well as learned Additional Public Prosecutor for the State have vehemently opposed the prayer for bail of the petitioners and submit that petitioner no.2 has got five criminal antecedents in which he is on bail in all cases and petitioner no.1 has clean antecedent.
6. Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial
Patna High Court CR. MISC. No.75580 of 2025(8) dt.30-03-2026 3/3 Magistrate, Vaishali, Hajipur in connection with Hajipur Sadar (Kazipur) P.S. Case No. 244 of 2025, subject to the following conditions:- i. Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the Court below. ii. If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioners and in case at any stage it is found that the petitioners have concealed their criminal antecedents, the court below shall take step for cancellation of bail bond of the petitioners. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
