The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

It is alleged against the petitioner that he along with other accused persons have brutally assaulted the informant and his father.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.81383 of 2023(2) dt.15-12-2023 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The informant and petitioner are agnates and neighbours and in the background of some land dispute, the present accusation has been levelled against the petitioner. Moreover, all the injuries except one injury sustained on the palm of the informant, are simple in nature. No injury was found on the vital part of the body. The petitioner is languishing in custody since 24.07.2023. Moreover, other similarly situated co-accused has been granted bail vide order dated 28.11.2023 passed in Cr. Misc. No. 72345 of 2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
