1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Birpur Police Station Case No. 65 of 2025, dated 27.03.2025, disclosing offences under Sections 126(2)/115(2)/352/351(2)/109/117(2)/303(2)/3(5) of the Bhartiya Nyaya Sanhita.

3. The prosecution case, as per First Information Report, is that the informant on 26.03.2025, while informant's wife was returning home from shop, in the meanwhile, she was

Patna High Court CR. MISC. No.77581 of 2025(2) dt.23-12-2025 2/3 intercepted by the petitioners, along with co-accused persons, who were armed with rods, sticks and lathis. It is alleged that the accused persons abused her and assaulted her. Upon alarm being raised, the informant and his sons rushed to intervene, whereupon the accused persons assaulted them with rods, khanti, lathis with intent to kill.

4. Learned counsel for the petitioner submits that both the petitioner nos. 1 and 2 are ladies and the petitioner no. 3 is husband of the petitioner no. 2. He next submits that both the parties are agnates and neighbours and the petitioners have falsely been implicated in the present case due to previous enmity. He further submits that allegations against the petitioners are general and omnibus in nature and only one injury which has been sustained by the informant on his head is grievous in nature. The husband and son of the petitioner no. 1 were arrested and have been granted regular bail by a Coordinate Bench of this Court in Cr. Misc. No. 69148 of 2025.

5. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that the petitioner nos. 1 and 2 are ladies, there is no specific

No.77581 of 2025(2) dt.23-12-2025 3/3 allegation against the petitioners and husband and son of the petitioner no. 1 were arrested and have been granted regular bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Begusarai, in connection with Birpur Police Station Case No. 65 of 2025, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
