Patna High Court Cr.Misc. No.15955 of 2018 (2) dt.06-04-2018 2/3 arrest in connection with Sigori P.S. Case No. 105 of 2017, dated 09.10.2017, instituted for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 326, 448, 427 and 354 of the Indian Penal Code.
With respect to a dispute over partition of land, an occurrence had taken place in which the members of the prosecution side have received injuries. So far as petitioners are concerned, though they have been named in the First Information Report, but no overt act has been alleged against them.
It has been submitted on behalf of the petitioners that there is a counter case vide Sigori P.S. Case No. 104 of 2017, which has been instituted for the offence under Sections 302/34 of the Indian Penal Code. In the aforesaid case, it has been alleged that the family members of the informant had killed the uncle of petitioner Nos. 1 and 2. Some of the other accused persons with similar allegations against them, have been granted bail by a Bench this Court.
Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand)
