This is an application for grant of anticipatory bail in connection with Jhanjharpur (Arariya Sangram) P.S. Case No. 72 of 2017 registered for the offence punishable under Sections 365 and 366 of the Indian Penal Code.

The allegation of the prosecution is regarding abducting the victim girl.

The learned counsel for the petitioner has referred to the statement of the victim girl recorded under Section 164 of the Cr.P.C. wherein the victim girl has stated that it was not the petitioner herein who had abducted her but she had voluntarily gone with the petitioner herein and solemnized marriage, hence a false case has been lodged by the informant of the present case

Patna High Court Cr.Misc. No.9820 of 2018(2) dt.20-02-2018 2/2 against the petitioner herein.

Having regard to the facts and circumstances of the case, deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Jhanjharpur, District-Madhubani in connection with Jhanjharpur (Arariya Sangram) P.S. Case No. 72 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
