JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 23-03-2023 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition in respect of petitioner no.2, namely, Manoj Kumar Ray @ Bara Baua as he has already been granted bail by the learned court below itself.

Permission is granted.

Accordingly, this anticipatory bail petition is dismissed as withdrawn so far as petitioner no.2, Manoj Kumar Ray @ Bara Baua is concerned.

Now, the instant anticipatory bail petition survives only against petitioner no.1, Mukesh Kumar @ Ravi. Heard learned counsel for the petitioner and learned

Petitioner No.1, namely, Mukesh Kumar @ Ravi apprehends his arrest in connection with (Danapur) Khagaul P.S. Case No.161 of 2022, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 379 and 506 of the Indian Penal Code.

The petitioner is said to have assaulted the son of the informant by means of iron rod causing bleeding injury in his head.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got one criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the injuries sustained by the injured persons are simple in nature (Annexure-2 series of the bail petition).

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, let petitioner, namely, Mukesh Kumar @ Ravi, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on
