2. The petitioner is in custody in connection with Rupaspur P.S Case No. 146 of 2025 registered for the offences punishable under Sections 304(2) and 112(2) of B.N.S.
3. As per prosecution case, two unknown persons have snatched the gold locket chain from the informant.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner is not named in FIR his name surfaced from the confessional statement of the co-accused. It is also submitted that petitioner is in judicial custody since 19.05.2025..
5. However, learned APP for the State oppose the
Patna High Court CR. MISC. No.78430 of 2025(2) dt.03-12-2025 2/2 prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order, it appears that petitioner is not named in FIR his name surfaced from the confessional statement of the co-accused. Nothing recovered from the conscious possession of the petitioner. No Test Identification Parade was conducted during the investigation by the Investigating Officer.
7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM-II, Patna in connection with Rupaspur P.S Case No. 146 of 2025, subject to the condition that petitioner shall present each and every date fixed by the trial Court till conclusion of the trial. If in any case, petitioner is not remain present then, trial Court shall consider for cancellation of his bail bond.
