Petitioner seeks anticipatory bail in Patori (Mohanpur O.P.) P.S. Case No.302 of 2017 instituted for the offence under Sections 195, 120B of the I.P.C. and Section 27 of Arms Act. The case has been registered on the basis of written statement of S.H.O. Mohanpur O.P. wherein it has been alleged that the petitioner has lodged a case of kidnapping of his son. The said case, in course of investigation was found false by the police and thereafter police lodged this case against the petitioner and his son for the offence under Sections 195 and 120B of the IPC and 27 of the Arms Act.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.9011 of 2018 (3) dt.27-02-2018 2/2 petitioner has filed protest petition against final form which is still pending and the petitioner has no criminal antecedent. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Samastipur, in Patori (Mohanpur O.P.)
