JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-06-2020 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State through video conferencing. Petitioner apprehends his arrest in connection with Bhagwanpur P.S. Case No. 68 of 2019 registered for the offences punishable under Sections 341, 323, 354(b), 379, 307, 504, 34 of the Indian Penal Code.

Petitioner is said to have given rod blow on the head of the informant. The injury report of informant goes to show that she sustained two injuries, said to be caused by hard and blunt substance but both the injuries are simple in nature. The allegation of snatching chain and cash is against co-accused and so far as allegation of Section 354(b) of the

Patna High Court CR. MISC. No.69718 of 2019(4) dt.29-06-2020 2/2 I.P.C. is concerned, the same appears to have been made with an object to make the offence graver.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur in Bhagwanpur P.S. Case No. 68 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) shahzad/- U T
