The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 323, 353 and other allied sections of the Indian Penal Code. As per the prosecution case, the informant SHO of Gaunaha PS received information from his superior officer that some miscreants had attacked on Balthar PS and were damaging the vehicles and other articles. On receipt of information, informant along with police personnel arrived at Tinmuhani at Balthar Bazar, a mob of thousand people surrounded the police party, started pelting stones and bricks. The informant tried to pacify, but they became aggressive and attacked on the police party and also tried to snatch their arms. The accused persons

Patna High Court CR. MISC. No.884 of 2023(2) dt.27-03-2023 2/2 also set on fire the police vehicles. On identification of Chaukidar this petitioner has been made accused in this case. It is submitted that petitioner has been made accused on the identification of local Chaukidar. There is general and omnibus allegation. Only allegation is that petitioner is member of the mob. Similarly situated co-accused have been granted bail by different Benches of this Court.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IVth, West Champaran at Bettiah in connection with Balthar P.S.
