The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 103(1), 61(2) and 3(5) of B.N.S. and Section 27 of the Arms Act which was earlier rejected vide order dated 04.04.2025 with an observation that the petitioner may be at liberty to renew his prayer for bail after six months if the trial is not concluded.
3. The case of the prosecution is that one Rajesh Prasad who was informant in this case, later on, became accused, has stated that while he was going on a bike with his sister-in-law, unknown miscreants killed her.
4. Learned senior counsel for the petitioner has submitted
Patna High Court CR. MISC. No.76156 of 2025(2) dt.28-11-2025 2/3 that during the course of investigation, it has come that the version which has been disclosed by Rajesh is not believable and he has been made an accused. In this case, Rajesh Prasad has given his confessional statement, in which he named this petitioner. Learned counsel for the petitioner has submitted that the name of this petitioner has been disclosed by one of the coaccused and only material against this petitioner is that on his disclosure, the weapon of assault was recovered. It has also been submitted that there are two confessional statements in this case and the name of this petitioner has been dragged in this case only on the basis of confessional statement. There is no direct allegation against this petitioner. Moreover, he is languishing in judicial custody since 27.07.2024. It has also been submitted that though the weapon has been recovered on the disclosure of this petitioner, prosecution has to prove that the recovered weapon was used in the commission of weapon.
5. Learned senior counsel for the petitioner has also submitted that he has filed entire order sheet of the learned trial court and from perusal of which, it goes to show that though charges have been framed on 27.08.2025 but no witness has been examination till 25.09.2025.

7. Having heard learned counsel for the parties and considering the above facts and circumstances of this case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Nawada (Muffasil) P.S. Case No. 215 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Nawada.
