The petitioner apprehends his arrest in Marhaura P.S. case No. 52 of 2019 registered under Section 341, 323, 324, 325, 307, 379, 506,34 of the IPC.

The informant named the petitioner and others and alleged that on account of tying buffalo some quarrel took place between two sides. The petitioner is alleged to have assaulted the wife and brother of the informant.

The learned counsel for the petitioner submits that wife and brother of the informant got simple injuries. Uttam Rai and Suresh Rai, who are assailants of the informant, have already been granted anticipatory bail vide order dated 10.07.2019 passed in Cr. Misc. No. 25968 of 2019. There is counter version being Marhaura P.S. case No. 74 of 2019.

No.69575 of 2019(2) dt.15-11-2019 2/2 Taking into consideration the fact that on account of assault made by the petitioner the wife and the brother of the informant got simple injuries, as stated by the petitioner in paragraph 7 of the bail petition, and similarly situated accused have already been granted anticipatory bail, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra in connection with Marhaura P.S. case No. 52 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
