Patna High Court CR. MISC. No.80342 of 2024(2) dt.04-12-2024 2/2

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail and submitted that the vehicles from which huge quantity of illicit liquor was recovered were brought by the petitioner for the purpose of sale and apart from this, petitioner has one criminal antecedent and that too of similar nature and, as such, petitioner don't deserve to be released on bail.

6. Considering the huge quantity of recovery of illicit liquor and also the fact that petitioner has one criminal antecedent under Excise Act, I am not inclined to grant prearrest bail to the petitioner. Accordingly, the present bail application stands dismissed.
