The petitioner seeks pre-arrest bail in connection with Amour P.S. Case No. 61 of 2017 registered under Sections 420 read with 34 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

It is submitted by the learned counsel for the petitioner that the named accused Md. Hashim has already been granted pre-arrest bail vide order dated 21.09.2017 passed in Cr. Misc. No.43295 of 2017 by a co-ordinate Bench of this Court.

Patna High Court Cr.Misc. No.18105 of 2018 (2) dt.05-04-2018 So far as the petitioner is concerned, his name has been transpired in course of investigation as driver of the vehicle on which the accused persons were carrying seven bags of rice. Having regard to the nature of allegation and the reasons assigned in the aforestated order dated 21.09.2017 as contained in Annexure-2 to the present application, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Purnea in connection with Amour P.S. Case No. 61 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C.
