2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 318(4), 338, 336(3), 340(2), 317(5), 61(2) of BNSS and Sections 30(a), 32(2), 36 and 41(1) of the Bihar Excise and Prohibition and Excise Act. 3 . As per the prosecution case, total 3548 litres of illicit liquor was recovered out of which 2259 litres of illicit liquor recovered from the seized truck .

4. It is submitted on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case . The name of the petitioner transpired in this case , in the confessional statement of other co-accused persons. Petitioner is

Patna High Court CR. MISC. No.75690 of 2025(2) dt.05-02-2026 2/2 neither owner nor driver of the seized truck . No incriminating article has been recovered from the possession of this petitioner. Petitioner claims clean antecedent.

5 . Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court Excise - 1, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 721 of 2024 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 .
