Mr.Pramod Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 22-06-2023 At the outset, learned counsel for the petitioner submits that he does not want to press the jointness petition as it has wrongly been filed.

Heard both sides.

The petitioner apprehends his arrest in connection with Benipatti P.S. Case No.92 of 2013, registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code.

It is alleged that the petitioner had taken consideration amount for selling a piece of land from the informant, but the petitioner and his father fled away from the Registry Office after signing the deed.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.55 of 2023(4) dt.22-06-2023 2/2 petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the petitioner has already returned the consideration amount received by him to O.P. No.2. It is submitted that the dispute is purely civil in nature.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Benipatti, District Madhubani in connection with Benipatti P.S. Case No.92 of 2013, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. (Anjani Kumar Sharan, J) S.KUMAR/- U T
