The petitioner is apprehending his arrest in connection with Thakurganj P.S.Case nO.78 of 2018 registered for offences punishable under Sections 302, 201 and 120(B) of the Indian Penal Code.

Allegation against the petitioner as per FIR is that the informant saw the petitioner and the other accused persons and hanging his borhter Sufed Akhtar and further allegation is that the petitioner had earlier threatened his brother of dire consequences. Submission of the learned counsel for the petitioner is that except informant there is no witness in this case and investigation is pending for two months and further submission is that she is an old lady.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender within a period of four weeks from the date of receipt of this order and make prayer for regular bail, which will be considered on the basis of materials available on the record and also considering her age. With the aforesaid observation, this application is disposed of.
