The petitioner seeks anticipatory bail in connection with Raghunathpur P.S. Case. 194 of 2015, registered for offences punishable under Sections 341, 323, 379, 504/34 of the Indian Penal Code.

Allegation against the petitioner is that the petitioner alongwith others brought the informant to their house and assaulted the informant by lathi and danda, causing injuries on the person of the informant and also snatched his golden chain and fled away.

Submission of the learned counsel for the petitioner that the injuries are simple in nature and earlier the police on the undertaking of the petitioner under Section 41A Cr.P.C. released the petitioner and now chargesheet has been submitted and the

Patna High Court Cr.Misc. No.24760 of 2018 (2) dt.04-05-2018 2/2 petitioner had not misused the privilege.

Learned A.P.P. opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances discussed above, let the petitioner, above named, surrender before the Court below and make prayer for regular bail, which will be considered by the learned court below considering that earlier the petitioner on undertaking before the police, was released and he had not misused the same. This application is accordingly disposed of.
