The petitioner apprehends his arrest in connection with Parwalpur P.S. Case No.218 of 2022, registered for the offences punishable under Sections 341, 323, 504, 506, 354(A) (B) and 34 of the Indian Penal Code and Sections 8/12 of the POCSO Act.

The petitioner is said to have tried to outrage the modesty of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the petitioner has falsely been implicated in the instant case due to land dispute.

Patna High Court CR. MISC. No.275 of 2023(2) dt.07-02-2023 2/2 Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner by submitting that the victim girl is minor and she has supported the prosecution case in her statement recorded under Section 164 Cr.P.C. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected.
