2. This is 2nd anticipatory bail application on behalf of the petitioner. Earlier, the prayer for anticipatory bail was rejected, vide order dated 22.09.2022 passed in Cr. Misc. No. 25835 of 2022 (Annexure - 1 to the petition).

3. The petitioner has renewed his prayer for bail on the ground that during investigation, it was found by CSP company that some irregular transactions happened, out of which, some amount automatically deducted from the account of customer, then the bank, through the CSP, returned back the amount into the account of informant and others (copy of consolidated report is annexed as Annexure - 3 to the petition). After realizing the fact that petitioner has no hand in the alleged transaction, the informant entered into a compromise with the petitioner and filed the same in the Court below (Annexure - 4).

4. Learned counsel for the informant/opposite party no. 2 does not dispute the contention made on behalf of the petitioner.

5. In that view of the matter, the anticipatory bail application of petitioner is allowed. Let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Pirpainty P.S. Case No. 48 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
