JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-05-2024 The present writ petition has been filed seeking the following reliefs:- "1.(i) For issuance of an appropriate writ/writs to quash and set-aside the order dated 10.06.2023 contained in Memo No. 356 issued by the respondent Assistant Inspector General of Registration, Saran by which a direction has been given to the petitioner to deposit deficit stamp of rupees 1,53,198/- (the deficit stamp fee of Rs. 1,39,271/- + Fine of Rs. 13,927/-, a total of Rs.

1,53,198/-) and has further ordered to deposit the same within 60 days failing which 5% monthly interest will be charged for registration of a land situated in Village-Chhitauli Kala, Thana No. 114, Khata No. 8, Khesra No. 804 for total area of 29.767 decimal showing "Bhith" land

Patna High Court CWJC No.16724 of 2023(2) dt.14-05-2024 2/2 whereas the aforesaid land comes under "Commercial" category.

In the sale deed boundary of the said land has been categorically mentioned and without verifying the same, on the basis of a complaint made by enemy of petitioner, the respondent has directed to deposit the aforesaid deficit stamp.

(ii) For a direction to the respondent to stay further proceedings of said order dated 10.06.2023 contained in Memo No. 356 issued by the respondents."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to assail the order dated 10.06.2023, passed by the Assistant Inspector General, Registration, Saran Division, Chapra, by filing appropriate appeal under Section 47A4 of the Indian Stamp Act, 1899. Liberty, so sought, is granted.

The writ petition stands disposed off.
