JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Bidupur P.S. Case No. 147 of 2018 registered for the offences punishable under Sections 147, 149, 447, 341, 323, 324, 307, 379, 354, 504 and 506 of the Indian Penal Code. As per FIR the accused persons, including the petitioners assaulted the informant and tried to disrobe her. Submission of learned counsel for the petitioners is that no specific allegation has been attributed against any of the petitioners and impugned order disclosed that injuries are simple in nature and there is land dispute between the parties and considering the same other co-accused persons have been granted anticipatory bail by order dated 25.4.2019 in
Patna High Court CR. MISC. No.69414 of 2019(2) dt.05-11-2019 2/2 Cr.Misc.No. 9861 of 2019.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 147 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
