Mr.Ram Anurag Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-03-2023 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498(A), 376 and other allied sections of the Indian Penal Code. Prosecution case in brief is that the informant Puja Kumari was married to one Sonu Rai and out of the said wedlock she got two sons. Sonu Rai died in the year 2019. It is further alleged that her brother-in-law (Dewar) forcibly made physical relation with her. When the informant complained about the same before the petitioner (father-in-law), he also sought sexual favour from her. It is further alleged that the inlaws of the informant took her ornaments and cash of his

It is submitted that petitioner is father-in-law of the informant and he has been falsely implicated in this case only with a view of grab his property. Moreover, the date of occurrence alleged to be from 12.06.2012 to 22.08.2019, but the informant lodged this case on 18.07.2022 after long delay without any plausible explanation. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Saran in connection with Mahila P.S. Case No. 66 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
