1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Akilpur P.S. Case no.1 of 2022 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, it is stated by the informant that two persons on another motorcycle forcibly stopped him and took away Rs.15,400/ in cash.

4. Learned counsel for the petitioner submits that the F.I.R. was registered against two unknown accused persons. Referring to the order of the learned trial Court, learned counsel submits that the petitioner was falsely implicated in the case on the basis of his confession recorded before the police in one another case from which he was taken on remand in the instant case on 2.7.2022. Inspite of his being in custody for nine

Patna High Court CR. MISC. No.258 of 2023(2) dt.29-04-2023 2/2 months, he has not been put on T.I. parade and chargesheet has been submitted in the case. No incriminating article was recovered from his possession.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and having perused the material on record as also the contents of the order of the learned court below, it transpires that the petitioner was remanded in the instant case on the basis of his confession recorded in Sonepur 340 of 2022. No incriminating article has been recovered from his possession. He is in custody since 2.7.2022, has not been put on T.I. parade and chargesheet has been submitted in the case.

7. In the facts of the case, the Court directs the petitioner to be enlarged on bail in connection with Akilpur P.S. Case no.1 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra.
