Petitioners are apprehending their arrest in connection with Dulhin Bazar P.S.Case No.208 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 333, 332, 152, 337, 353, 307 and 504 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are said to be a member of the mob and they were assaulting one boy mercilessly and when the police party

Patna High Court CR. MISC. No.71903 of 2019(2) dt.22-01-2020 2/2 reached there they have also attacked the police party also. It is further submitted that there is no specific role assigned to any one and petitioners having clean antecedent. It is also submitted that similarly situated co-accused persons who were also part of the member of the mob have been granted anticipatory bail by a coordinate Benches of this Court in Cr.Misc.No.71433 of 2019 on 08.11.2019 and Cr.Misc.No.72379 of 2019 on 27.11.2019. Considering the aforesaid fact, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender in the court below within a period of four weeks from the date of receipt of the order, on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Danapur, District-Patna/successor Court in connection with Dulhin Bazar P.S.Case No.208 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
