1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 379, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner no. 2 has antecedent of one case and rest of the petitioners are persons with clean antecedent and the informant alleges that on orders of Narendra Yadav, accused Arvind, Manoj and Mukesh assaulted Sajjan Yadav, the son of the informant by farsa and rod thereafter Lalan Yadav and Baua Yadav assaulted Prabhat Yadav and Jagdambi Yadav by butt of pistol causing injury on their head. Further, the accused also assaulted Keshav Kumar.

Learned counsel for the petitioners submits that no doubt, Prabhat Yadav and Jagdambi Yadav along with Keshav Kumar suffered grievous injury on account of assault but then Lalan Yadav and Baua Yadav are alleged to have assaulted Prabhat Yadav and Jagdambi Yadav and as far as Keshav Kumar is concerned, the allegation of assaulting him is general and omnibus in nature. It is further submitted that Sajjan Yadav also suffered simple injury and Arvind, Manoj and Mukesh are alleged to have assaulted him as such the allegation of assault is not specific. It is next submitted that on account of dispute

3/4 relating to election, the occurrence took place.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners and submits that there is specific allegation against Lalan Yadav of assaulting Prabhat Yadav and against Baua Yadav of assaulting Jagdambi Yadav and both of them have suffered grievous injury but then fairly submits that allegation of assaulting Keshav Kumar is not specific

6. After hearing the learned A.P.P. for the State, the Court is not inclined to extend the privilege of anticipatory bail to Baua Yadav @ Kaushal Yadav (petitioner no. 5) and Lalan Yadav (petitioner no. 6), accordingly, their anticipatory bail is rejected.

7. As far as petitioners no. 1 to 4 and 7 to 9 are concerned, let the petitioners no. 1 to 4 and 7 to 9 above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Simri Bakhtiyarpur (Balwahat O.P.) P.S. Case No. 366 of 2021,
