2. The petitioner seeks regular bail in connection with Naya Ram Nagar (Safia Sarai) P.S. Case No. 152 of 2023 registered on 28.06.2023 lodged under Sections 304(B)/34 of the I.P.C.
3. As per the prosecution case, F.I.R. has been lodged against 4 named accused persons including the petitioner to whom allegation that in-connivance with each other they have killed informant's sister due to non fulfillment of the dowry demand by burning her.
4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 29.06.2023 having no criminal case pending against him, in which he is on bail. Counsel further submits that
Patna High Court CR. MISC. No.83042 of 2023(3) dt.19-03-2024 2/2 petitioner who is father-in-law is an old aged person aged about 68-69 years and the husband of the victim girl is already in custody. He further submits that due to mis-happening this incident has occurred and immediately she was taken to the hospital where she died.
6. Learned counsel for the State opposes the prayer for bail.
7. Learned counsel for the informant vehemently opposes the prayer for bail and submits that victim has 94% burn injury and there is demand of dowry too.
8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Naya Ram Nagar (Safia Sarai) P.S. Case No. 152 of 2023, subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
