The admitted facts, as per submission of the parties is, entitlement of the petitioner for compassionate appointment in place of his father (Late Mahesh Tiwari), who was working as a 'Cook' in the Bihar Home Guard at Siwan. The only issue coming in the way of grant of the benefit to the petitioner is that in the educational certificate which has been produced by the petitioner issued from Bharti Vidhyapeeth, Deoghar at Ranchi, his name has been mentioned as 'Amit

Patna High Court CWJC No.23213 of 2019(4) dt.19-12-2022 2/2 Kumar Tiwari' whereas in his application and some other documents the name appears as 'Amit Kumar'. The Authorities have requested the petitioner to get the certificate accordingly rectified/corrected as the mismatch is coming in the way of grant of appointment to the petitioner.

Learned counsel for the petitioner submits that the petitioner would be getting the certificate rectified from the competent Authority and approaching the District Commandant, Bihar Home Guard, Siwan, along with the corrected certificate for availing the benefit of compassionate appointment.

In view of such submissions, the writ application need not be kept pending.

With liberty to the petitioner to comply with the requirement, as per letter dated 15.03.2013 (Annexure-7), writ application is disposed of. (Madhuresh Prasad, J) shashank/- U
