====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has prayed for bail in connection with Hathua P.S. Case No. 46 of 2019 registered for the offences under Section 30(a), 41(I) (II) of the Bihar Prohibition & Excise Act.

As per allegation in the FIR, 164 litres of country liquor is said to have been recovered from the house of the Shanker Sah. It is further stated that the informant had received secret information that the petitioner and one Om Prakash Sah were in the business of selling illicit liquor and had hidden the liquor.

It is submitted by learned counsel for the petitioner that the admittedly no recovery has taken place from possession

The case of the petitioner stands on a better footing to that of Om Prakash Sah who has been granted anticipatory bail vide order dated 26.06.2019 passed in Cr.Misc. No. 32700 of 2019. It is further submitted that the petitioner has no criminal antecedent and is in custody since 30.06.2019. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge, Excise, Gopalganj, in connection with Hathua P.S.
