====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in case registered for the offence punishable under Section 392 of the Indian Penal Code. As per F.I.R., three unknown persons committed robbery, on the point of pistol.

Learned counsel for the petitioner submits that name of the petitioner transpired on the basis of confessional statement of co-accused Raju Tiwari and no incriminating article has been recovered from possession of the petitioner. He further submits that neither the petitioner is concerned with the alleged robbery nor he was present at the place of occurrence. Learned counsel for the State opposes the prayer for bail and submits that name of the petitioner transpired during

Patna High Court CR. MISC. No.127 of 2023(2) dt.08-05-2023 2/2 course of investigation and he has got one criminal antecedent of similar nature.

Considering the aforesaid facts and criminal antecedent of similar nature, prayer for anticipatory bail of the petitioner is rejected.
