JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This is an application for grant of anticipatory bail in connection with Suryagarha P. S. Case No. 59 of 2017, disclosing offences under Sections 366A/34 of IPC and Section 2/8 of POCSO Act.

As per F.I.R. there is allegation against the petitioner of kidnapping the minor daughter of the informant. Submission of the learned counsel for the petitioner is that the statement of the victim girl has been recorded under Section 164 Cr.P.C., in which, she has admitted her marriage with the petitioner, which will appear from the impugned order. She has a baby child also. They are residing together and the victim girl has also filed a petition before the learned court

Patna High Court CR. MISC. No.73670 of 2019(2) dt.25-11-2019 2/2 below stating all the aforesaid facts. It has also been submitted that now she has become major also.

Heard learned A.P.P. also.

Having heard both sides, considering the above submissions and as the girl has a baby child and she is residing with the petitioner, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, Lakhisarai, in connection with Suryagarha P. S. Case No. 59 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
