JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 26-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Mansi P.S. Case No. 183 of 2017 for the offences punishable under sections 147, 149, 353, 435, 427, 354, 307 and 504 of the I.P.C.
Allegedly, the petitioners and other FIR named accused persons and about 200 unknown were protesting and demanding compensation for the person who died in accident by the police vehicle and blocked the road and tried to set the jeep on fire, pelted stones and damaged the vehicle and also tried to kill the lady police officer by setting her on fire. . Patna High Court Cr.Misc. No.20999 of 2018 (2) dt.26-04-2018 2/2 general and omnibus allegation against the petitioners, similarly situated other co-accused Bullu Sah @ Bulbul Sah and five others have been allowed pre-arrest bail, vide Cr. Misc. No.58395 of 2017 and further B.P.Singh and three others have been allowed pre-arrest bail, vide Cr. Misc. No. 5686 of 2018 by another coordinate Benches of this Court and as such the petitioners deserve sympathetic consideration as they have got no criminal antecedents.
The learned A.P.P. fairly submits that similarly situated other co-accused have been allowed pre-arrest bail, as stated above.
In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Khagaria in connection with the aforementioned case, subject to the conditions as laid down under section 438 (2) of the Cr.P.C.
