JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Obra P. S. Case No. 252 of 2019 disclosing offence under Section 30 (a) of the Bihar Prohibition and Excise Act.
As per F.I.R. the police received an information that the petitioner is engaged in the sale of liquor and on that information, reached near the bank river and saw two persons counting sachets, on seeing the police party, they fled away and there is recovery of 58.5 liters of liquor.
Submission of the learned counsel for the petitioner is that except that petitioner is named only on confidential information, no any source of information is mentioned. He has no criminal antecedent.
Heard learned A.P.P. also, who has opposed the
Patna High Court CR. MISC. No.70348 of 2019(2) dt.16-01-2020 2/2 prayer for anticipatory bail.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-VII-cum- Special Judge, Excise, Aurangabad, in connection with Obra P. S. Case No. 252 of 2019.
