JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-11-2019 This application, for grant of anticipatory bail, arises out of Durgawati P.S. Case No. 129 of 2019, disclosing offences under Sections 147, 148, 149, 341, 323, 307, 386, 504 of the Indian Penal Code.

Allegation against the petitioner and others is that they assaulted the informant with an intention to kill him and it appears that occurrence took place with respect to transaction relating to supply of water bottle by one Banti Singh. Submission of learned counsel for the petitioners is that with respect to the same occurrence, three cases have been lodged one is present one, second one lodged by the petitioner side and third case has been lodged by the police, in which, the petitioner has not been named. Further submission is that only on injury was found on the person of the injured, whereas, six

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur, Bhabhua, in connection with Durgawati P.S. Case No. 129 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
