The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 326, 307, 302, 120(B) of the Indian Penal Code and 27 of the Arms Act. Allegedly, petitioner is said to have fired upon the informant's father due to which the father of the informant sustained fire arm injury. It is further alleged that the informant brought his father to P.H.C. with the help of local persons for treatment where doctor declared his father dead. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to previous grudge. There is specific
Patna High Court CR. MISC. No.281 of 2023(2) dt.04-02-2023 2/2 overt act against the petitioner that he fired upon the informant's father due to which he died. Both sides have filed cases against each other. Petitioner has four criminal antecedents as mentioned in para-3 of this application.
Learned APP for the State as well as learned counsel for the informant opposed the prayer for bail.
Considering the facts and circumstances of case, since there is specific overt act against the petitioner, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is hereby rejected.
