Petitioners seek anticipatory bail in Chiraiya P.S.Case No.203 of 2016 instituted for the offence under Section 366(A)/34 of the I.P.C.

Accusation is of kidnapping of minor daughter of the informant by Anod Rai with the help of his father Ram Badan Rai (petitioner no.2), mother Sarda Devi, sister Renu Kumari (petitioner no.1) for human trafficking.

Learned counsel appearing on behalf of the petitioners submits that, in fact, due to love affairs the daughter of the informant eloped with Anod Rai who happens to be brother and

He further submits that the victim gave her statement under Section 164 Cr.P.C. in which she has stated about carrying and boarding on motor cycle by Anod Rai for performing marriage and further adding about giving information by these petitioners and Sarda Devi that her maternal uncle was ill and her father was also present there.

Having considered the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran, in Chiraiya P.S.Case No.203 of 2016 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
