ABHISHEK REDDY ORAL ORDER 30-06-2025 Learned counsel appearing on behalf of the petitioners as well as the respondents has stated that the matter is fairly covered by the Order of this Hon'ble Court passed in CWJC No. 18127 of 2024 dated 30.04.2025 wherein, this Court has held that in cases where the Tribunal as preliminary issue holds that the domestic enquiry conducted by the management of the company is not proper, no prejudice would be caused to the management as they will have ample opportunity to lead evidence justifying the termination of the employee.

Having regard to the same, the present writ petition is disposed of with a direction to the Industrial Tribunal to complete the proceedings pending before it as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of this order. Further, it is made clear that Tribunal shall not be influenced by any of the findings recorded in the impugned order dated 28.08.2024 and shall deal with the case based on the evidence led by both the parties.

3. With the above direction, the present writ petition stands disposed of.
