The petitioner apprehends his arrest in Bihta P.S. Case No. 651 of 2019, registered for the offences punishable under Section 420 of the Indian Penal Code and section 138 of the Negotiable Instruments Act.

Prosecution case in brief is that cheque issued by the petitioner got bounced due to insufficiency of fund. It is submitted that cheque was issued by the petitioner to the informant not in lieu of the discharge of any of his liability, but only to fulfill the monetary requirements of the informant as help. Informant with mala fide intention lodged this false and fabricated case.

Considering the nature of accusation, I am not inclined to enlarge the petitioner above-named on anticipatory
