This is an application for grant of anticipatory bail in connection with Bisfi (Patauna) P.S. Case No. 3 of 2019 registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.

The allegation is regarding one Bablu Sahni having kidnapped the victim girl and taken her to Delhi. The learned counsel for the petitioners submits that the petitioners are the mother, brother, brother-in-law and sister of

Patna High Court CR. MISC. No.77936 of 2019(3) dt.20-12-2019 2/2 the said Bablu Sahni. It is further submitted that the record would show that apparently, the petitioners are not having any complicity in the matter and if at all, anyone is having complicity in the alleged crime, it is the co-accused Bablu Sahni. The petitioners are stated to be having a clean antecedent. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti in connection with Bisfi (Patauna) P.S. Case No. 3 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
