2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 384, 341, 323, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case, in brief, is that on 17.08.2015 at about 8:30 AM, all the F.I.R. named accused persons, including these petitioners, variously armed, abused and assaulted informant and his family members. It is further alleged that co-accused Umesh Yadav and Nivash Singh threatened the
Patna High Court CR. MISC. No.75763 of 2025(4) dt.15-01-2026 2/3 informant and also misbehaved with daughter of informant.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. From bare perusal of the F.I.R. it is apparent that these petitioners are only alleged to have assaulted informant and his family members along with other co-accused persons. Moreover, allegation of assault is general and omnibus. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Danapur in connection with Bihta P.S. Case No. 660 of 2015, subject to
