The present application has been filed for setting aside the order dated 29th August, 2019 passed by 1st Additional Sessions Judge-cum Special Judge (Children Act), Sitamarhi in Cr. Appeal No. 46 of 2019/17 of 2019 and the order dated 29th July, 2019 passed by the J.J. Board, Sitamarhi in J.J.B. Case No. 868 of 2019 arising out of Runni Saidpur P.S.Case No. 180 of 2019.

Allegation against the petitioner is that he was involved in snatching and looting a sum of Rs. 21,441/-, Rs.3,000/- and motorcycle of the informant on the point of pistol.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.05.2019. As stated specifically in para-7 of the application, till date no TIP has been made. In this case, case diary as well as social investigation report and the report of the Probation Officer were called for.

Patna High Court CR. REV. No.1345 of 2019(4) dt.22-05-2020 2/2 The Social Investigation Report, which is at flag -C, does not indicate that the petitioner is threat to the society. The petitioner has passed Intermediate examination in first class. Considering the totality of the facts and circumstances discussed above, the application is allowed. The order dated 29th August, 2019 passed by 1st Additional Sessions Judge-cum Special Judge (Children Act), Sitamarhi in Cr. Appeal No. 46 of 2019/17 of 2019 and the order dated 29th July, 2019 passed by the J.J. Board, Sitamarhi in J.J.B. Case No. 868 of 2019 arising out of Runni Saidpur P.S.Case No. 180 of 2019 are set aside. Let the petitioner, named above, be released on bail on furnishing his personal bond to the satisfaction of the J.J.Board, Sitamarhi in connection with J.J.B. Case No. 868 of 2019 arising out of Runni Saidpur P.S. Case No. 180 of 2019 and handed over to the custody of his father, the natural guardian forthwith, in view of the extra ordinary situation prevailing due to Covid-19.

The application stands allowed.
