It is submitted by Mr. Naushad Uzzoha, learned counsel for the petitioners that the application filed under Section 438 of the Code of Criminal Procedure was filed on behalf of altogether six petitioners, but due to inadvertence, while typing the order dated 27.02.2018, in the cause title the name of petitioner no.6 Md. Saijum @ Saijum son of Late Salim, resident of villageHaldia Bihar, P.S.-Simraha, District- Araria, has not been typed. Having seen the record of the case, the submissions
Patna High Court Cr.Misc. No.11823 of 2018 (3) dt.21-03-2018 2/2 made by the learned counsel for the petitioner is found correct. The petition has been filed on behalf of six petitioners and the order dated 27.02.2018 was passed in respect of all the six petitioners, but due to secretarial inadvertence the name of petitioner no.6 has not been typed in the cause title. In that view of the matter, let the order dated 27.02.2018 be deemed to have also been passed in respect of petitioner no.6 Md. Saijum @ Saijum whose details have been mentioned hereinabove.
