JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This application, for grant of anticipatory bail, arises out of Ahiyapur P.S. Case No. 712 of 2019, disclosing offences under Sections 363 and 366(A) of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.
Submission of learned counsel for the petitioner is that the impugned order itself shows that the girl in her statement under Section 164 Cr.P.C. has stated that she has solemnized marriage with the petitioner and residing with him at Patna and she has also disclosed her age as 18 years and impugned order also disclosed that even according to AADHAR Card, she is more than 17 years of age.

Having heard both sides, in view of the above facts,
Patna High Court CR. MISC. No.70066 of 2019(2) dt.15-11-2019 2/2 this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S.
