The petitioner apprehends his arrest in connection with Baruraj P.S. Case No.233 of 2018 registered under Sections 304(B), 201, 120(B)/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has been implicated in this case due to dirty village politics and some ulterior motive. No any specific overt act has been alleged against the petitioner.

Learned A.P.P. for the State vehemently opposed the prayer for bail of the petitioner stating that the petitioner is the husband of the deceased. The petitioner and other in-laws are alleged to have made an additional demand of dowry and due to

Patna High Court CR. MISC. No.711 of 2023(2) dt.08-05-2023 2/2 non-fulfillment of the same, they committed murder of the deceased. It is further submitted that the petitioner has been absconding since 2018. Therefore, the petitioner does not deserve anticipatory bail.

Having considered the above facts and circumstances of the case as well as the nature of allegations made against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for bail is rejected. (Arvind Srivastava, J) Harish/- U T
