2. The petitioner seeks pre-arrest bail in connection with Marauna P.S. Case No. 01 / 2023 registered for the offence(s) punishable under Sections 341, 342, 323, 376, 366A, 379, 504, 506, 509, 120(B), 34 of the Indian Penal Code and Sections 8, 6 and 20 of POCSO Act.
3. As per the FIR, petitioner is said to have established physical relationship with the informant on the pretext of marriage.
4. Mr. Prafull Chandra Thakur, learned counsel appearing on behalf of the informant submits that a counter
Patna High Court CR. MISC. No.84230 of 2023(4) dt.12-07-2024 2/2 affidavit has been filed on behalf of the informant, stating therein that she is willingly living along with the petitioner after solemnizing the marriage with him and she don't want to take any further legal step against the petitioner.
5. Considering the aforesaid information given on behalf of informant, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, in connection with Marauna P.S. Case No. 01 / 2023 pending in the Court of learned ADJ VI-cum-Spl. Judge, POCSO Court Supaul on such terms and conditions as the District Court deems it fit and proper.
