JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-05-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 341/307/34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, informant suspects that all the FIR named accused persons including the petitioner fired upon the informant causing injury on his thigh. Learned counsel for the petitioner submits that the there is general and omnibus allegation of assault against all the accused persons and no specific overt act has been alleged against the petitioner. He has been made accused in this case only due to land dispute with the informant. Petitioner claims clean antecedent. Similarly situated co-accused has already been allowed pre-arrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 2862/2023.

Patna High Court CR. MISC. No.961 of 2023(2) dt.08-05-2023 2/2 Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Beguserai in Barauni Police Station Case No. 435 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
