JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-11-2019 This application, for grant of anticipatory bail, arises out of Jandaha P.S. Case No. 216 of 2019, disclosing offences under Sections 363, 366(A) of the Indian Penal Code. Allegation is of kidnapping the minor daughter of the informant by the petitioners and their son.

Submission of learned counsel for the petitioners is that from perusal of the F.I.R, it appears that victim girl has eloped with the son of petitioners and due to which, the petitioners have falsely been implicated in this case and they are ready to abide by any condition imposed on them. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, ,

Patna High Court CR. MISC. No.69962 of 2019(2) dt.14-11-2019 2/2 this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Hajipur, Vaishali, in connection with Jandaha P.S. Case No. 216 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is further subject to the condition that petitioners have to appear before the Investigating Officer and will cooperate in tracing out the victim girl.
