2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 342, 323, 307, 328, 498 and 34 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added.

3. As per prosecution case, informant alleged that on 06.11.2015 at night, her husband, in a planned conspiracy with all the other F.I.R. named accused persons, including this petitioner, dragged her out of the house, assaulted her with knife and threw her. During course of treatment, the informant died.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case merely because he happens to be brother-in-law of the deceased. Petitioner is separate in mess and property and has got no concern with the affairs of the deceased and her husband. Thrust of accusation is against husband of deceased. Police after investigation submitted final form against this petitioner. Petitioner, having no criminal antecedent, is in custody since 30.06.2025. Moreover, charge-sheet has already been submitted.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, clean antecedents of the petitioner and period of custody, the prayer for grant of bail to the petitioner is allowed.

7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikarhana at Motihari, East Champaran in connection with Ghorasahan P.S. Case No. 384 of
